New Car Quality Masterclass Giveaway – August 2021

  1. The promoter

    1. The promoter is: Auto Trader Limited of 1 Tony Wilson Place, Manchester M15 4FN (“Promoter” or “Auto Trader”).
  2. The competition

    1. The title of the competition is “New Car Quality Competition”.
    2. Each week in August 2021, the Promoter will run the competition for entrants who meet the eligibility criteria set out in these terms and conditions. The entrant who achieves the highest overall week-on-week Performance Rating, the most accurate metric from which to gauge advert quality, for their new vehicle adverts will be eligible to receive the prize.
    3. Applies to new vehicle adverts only, entrants must have an active new vehicle advertising package to be considered.
    4. A total of 5 winners will be selected, one for each week of August.
    5. All entrants that meet the criteria in clause 3.2 will be entered into a computer process to determine the largest weekly increase in overall Performance Rating, with winning entrants selected no later than 5 working days after each weekly period (“Weekly Prize Period”).
    6. The prize will be a bespoke masterclass and business consultation from Nick King, Insight Director at Auto Trader.
  3. How to enter

    1. The competition will run from 00:00 on 2nd August 2021 (the "Opening Date") to 23:59 on 1st September (the "Closing Date") inclusive (the “Competition Period”).
    2. To enter the competition:
      1. No active entry to the competition is required, all active retailers that meet the eligibility criteria outlined in clauses 2.3 and 4 will be considered as entrants.
      2. Should you not wish to be considered for entry to this competition, please contact the promoter (Auto Trader) at brandnew@autotrader.co.uk.
      3. Entrants who win during one Weekly Prize Period will not be eligible for winning the prize again during the Competition Period.
    3. No additional purchase necessary to enter the competition.
    4. The competition entries will be judged automatically by a computer process used to monitor retailer performance on Auto Trader. The metric used to determine the winner will be Performance Rating, a proprietary Auto Trader metric and the best measure of changes to advertising quality for new vehicles. Each week, the retailers with the largest weekly percentage increase in overall Performance Rating will be entered into a league table, from which the top retailer will be selected to receive the prize for that week. If such a retailer has already received a prize in a previous week, the second entrant of the league table shall be selected. Should this retailer also have received a prize, the same process will follow until the next non-winner has been reached.
  4. Eligibility

    1. The competition is only open to all Auto Trader retailer customers in the UK aged 18 years or over (who have a current Advertising Agreement for New Vehicles with the Promoter), except:
      1. employees of the Promoter or its holding or subsidiary companies;
      2. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
      3. members of the immediate families or households of (a) and (b) above.
    2. Each automatically entered retailer will only count as one entry to the competition.
    3. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
  5. The prize

    1. The prizes are 5x bespoke masterclasses and business consultations with Auto Trader Insight Director, Nick King.
    2. The prize is provided and fulfilled by Auto Trader.
    3. Prizes are subject to availability. There is no cash alternative for the prize.
    4. The prize is not negotiable or transferable.
  6. Winners

    1. The decision of the Promoter is final and no correspondence or discussion will be entered into.
    2. The Promoter will contact each of the 5 winners as soon as practicable after the Weekly Prize Period, using the telephone number or email address provided as part of their current Auto Trader Advertising Agreement.
    3. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the business names of the 5 winners and, evidence of the Performance Rating increase, to anyone who emails brandnew@autotrader.co.uk or writes to the address set out in clause 1 (enclosing a self-addressed envelope) within one month of the end of the Competition Period. If you object to your business name and/or winning entry being made available, please contact the Promoter at the address set out in clause 1. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
  7. Claiming the prize

    1. Please allow up to 5 working days to be contacted to confirm receipt of the prize, from the end of the Weekly Prize Period. The Promotor will arrange directly with you when, where and how you would like to redeem your prize.
    2. The Promoter will make all reasonable efforts to contact the winners. If a winner cannot be contacted or is not available, or has not claimed their prize within 5 days of us contacting you, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received.
    3. The Promoter does not accept any responsibility if you are not able to take up the prize.
  8. Limitation of liability

    1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. Ownership of competition entries and intellectual property rights.
  9. Ownership of competition entries and intellectual property rights

    1. You agree that the Promoter may, but is not required to, make your entry available on its website, trade.autotrader.co.uk, social media platforms and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
  10. Data protection and publicity

    1. The Promoter will only process your personal information as set out in these terms and the Promoter’s privacy policy located at https://www.autotrader.co.uk/privacy-policy.
  11. General

    1. Entrants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry.
    2. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    3. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligations.
    4. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    5. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
