ATFestive Giveaway 2019

The Promoter

The promoter is: Auto Trader Limited of 1 Tony Wilson Place, Manchester M15 4FN.

  1. The prize draw

    1. The title of the prize draw is “Auto Trader Festive Giveaway”.

  2. How to enter

    1. The prize draw will run from 10:00 on 9th December 2019 (the "Opening Date") until 16:59 on 20th December 2019 (the "Closing Date") inclusive, but excluding Saturday 14th December and Sunday 15th December 2019 (the "Competition Period").
    2. The Promoter will post a new question on the @ATInsight Twitter feed between 10:00 and 16:59 every day during the Competition Period.
    3. In order to enter the prize draw, entrants (who must meet the eligibility criteria in paragraph 3 below) are required to retweet the @ATInsight Twitter post along with their answer to the question and the hashtag #ATFestive.
    4. All prize draw entries must be received by the Promoter in accordance with paragraph 2.3 above by no later than 16:59 on any day during the Competition Period. All prize draw entries received after 16:59 on any day during the Competition Period, or after the Closing Date, will automatically be disqualified.
    5. The Promoter will publish the correct answer to the question as soon as possible after 16:59 each day during the Competition Period.
    6. All entrants that post the correct answer to the question in accordance with paragraph 2.3 above, and otherwise comply with these terms and conditions, will be entered into a draw after 16:59 on the relevant day during the Competition Period. The winning entry will be selected by random draw. The winning entry each day will win a £50 Amazon e-gift voucher.
    7. There is no charge to enter the prize draw and no purchase is necessary.
    8. The Promoter will not accept responsibility for prize draw entries that are lost, mislaid, delayed, or otherwise not received by the Promoter, regardless of cause, including (without limitation) due to equipment failure, technical malfunction, systems, satellite, service, network, server, computer hardware or software failure or unavailability of any kind.
    9. By submitting a prize draw entry, you are agreeing to be bound by these terms and conditions.

  3. Eligibility

    1. The prize draw is only open to UK residents aged 18 years or over who work within the automotive retail or manufacturing industry, or an automotive trade body, who have a valid Twitter account, except:
      1. employees of the Promoter or its holding or subsidiary companies;
      2. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the prize draw or its administration; or
      3. members of the immediate families or households of (a) and (b) above.
    2. In entering the prize draw, you confirm that you are eligible to do so and eligible to claim the prize if you win. The Promoter may require you to provide proof that you are eligible to enter the prize draw.
    3. The Promoter will not accept prize draw entries that:
      1. are political in nature;
      2. feature content which is likely to be inconsistent with the brand values of the Promoter or which is otherwise considered offensive or derogatory by the Promoter;
      3. are automatically generated by computer;
      4. are completed by third parties, or in bulk;
      5. are illegible, have been altered, reconstructed, forged or tampered with; or
      6. are incomplete.
    4. There is a limit of one entry per Twitter account per day during the Competition Period.
    5. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.

  4. The prize

    1. The prize is one Amazon e-gift voucher to the value of £50, which will be awarded to a prize draw winner each day during the Competition Period.
    2. The winner will be required to redeem the Amazon e-gift voucher using a valid Amazon account at www.amazon.co.uk. The Promoter has no control over the products/services which the prize can be redeemed for and therefore, without prejudice to the generality of paragraph 7 below, the Promoter shall, to the furthest extent permissible by law, have no liability to the winner for any loss or damage suffered by the winner in connection with such products/services.
    3. There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of equal or greater value if circumstances beyond the Promoter's control makes it necessary to do so.
    4. The prize is not negotiable or transferable.

  5. Winner

    1. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
    2. The Promoter will contact the winner via direct message on Twitter as soon as practicable on the next working day after the prize draw is made.
    3. To claim the prize, each winner must respond to the Promoter's direct message on Twitter by emailing ATPress@autotrader.co.uk. This must be done at the latest by 17:00 on Monday 30th December 2019. Where the winner is a corporate Twitter account, the Promoter shall be entitled to treat the individual responding to the Promoter's direct message as having authority to do so on behalf of the corporate entity and the Promoter shall not be obliged to carry out any checks in this regard.
    4. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation, the Promoter will publish the name of the winning Twitter account on Twitter via @ATInsight daily by 10:00 the next working day after each draw is made during the Competition Period.
    5. If you object to your Twitter account name being published as set out in paragraph 5.4, please contact the Promoter by emailing ATPress@autotrader.co.uk at the time that you enter the prize draw. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

  6. Claiming the prize

    1. Following the winner's email in accordance with paragraph 5.3 above, the Promoter will send the prize by email to the same email account. Please allow 4 working days for delivery of the prize. The winner should check their junk mail folder in case the email goes into there.
    2. The prize may not be claimed by a third party on your behalf.
    3. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize by 17:00 on Monday 30th December, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

  7. Limitation of liability

    1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

  8. Ownership of prize draw entries and intellectual property rights

    1. You agree that the Promoter may, but is not required to, make your entry available on its website(s), social media platforms and any other media, whether now known or invented in the future, and in connection with any publicity of the prize draw. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the prize draw entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the prize draw entry and any accompanying materials for such purposes.

  9. Data protection and publicity

    1. The Promoter will only process your personal information as set out in the privacy policy located at https://www.autotrader.co.uk/privacy-policy.

  10. General

    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.
    2. If an act, omission, event or circumstances occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations under this terms and conditions.
    3. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.
    4. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
